1. Subject Matter

1.1 These General Terms and Conditions (hereinafter referred to as the "GTCs") govern the terms and conditions for the provision of services through the online store on the website www.hopperandcopper.com, for Second Circle brand spirits, marketed by Maltaria Unipessoal Lda., with headquarters at Estrada da Circunvalação N12 4D, under the unique registration and legal entity identification number 515973122, with a share capital of €5,000 (euros), hereinafter referred to as "Maltaria Unipessoal Lda.".

1.2 The purchase of any product in the online store on the website www.hopperandcopper.com implies acceptance of these GTCs.

1.3 Any and all alcoholic beverages available for sale in the online store on the website www.hopperandcopper.com can only be purchased by persons over 18 years of age (Decree-Law No. 106/2015).

2. Product Information, Prices and Content

2.1 Maltaria Unipessoal Lda. reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on its website. This includes products, prices, promotions, commercial conditions and services.

2.2 The images that illustrate each product on the website www.hopperandcopper.com may differ from the product subsequently delivered. The images are only visual representations and may not correspond exactly to the final product. In addition, products are subject to stockouts.

2.3 In accordance with Portuguese law, all prices presented in the online store on the website www.hopperandcopper.com include the respective VAT rates in force.

3. Payment

3.1 Purchases made on the website www.hopperandcopper.com are protected by security measures.

3.2 All purchases made in the online store imply their immediate payment.

3.3 Maltaria Unipessoal Lda. only processes an order placed by a customer after confirmation of the respective payment, so it cannot guarantee the availability of the items until the start of said processing.

3.4 Payments are received in euros.

3.5 After payment, a document proving the purchase (receipt invoice, or simplified invoice) will be issued, which may be personalized with the customer's tax data.

4. Delivery Service

4.1 For all purchases made in the online store on the website www.hopperandcopper.com, the customer may request free delivery, starting from €50 of purchases, with the exception of those made for delivery of products to the Madeira archipelago and the Azores. In these cases, the shipping cost will have to be calculated.

4.2 Deliveries are made by our logistics partner MRW, in a minimum of 24 hours and a maximum of 72 hours, within business hours.

4.3 Maltaria Unipessoal Lda. is exempt from any liability for any delay or impossibility of processing the order arising from an error or insufficiency of the data communicated by the end consumer.

 

5. Returns

 

5.1 The customer may electronically fill out and send the Right of Withdrawal form provided for in Decree-Law No. 24/2014, of February 14, or any other unequivocal statement of withdrawal ("Withdrawal Statement") through the communication channels defined in these Terms and Conditions.

5.2 The return by the customer (without collection at home) of any small and medium-sized product must be made within a maximum period of 14 (fourteen) days after the communication of the decision to terminate the contract under the Right of Withdrawal, and the customer must immediately return the order products.

5.3 After exercising the Right of Withdrawal from the contract, the refund of the amount paid by the customer (not including the costs that the customer has paid for the delivery of the product) will be made through the same payment method that was used in the initial transaction, without costs for the customer and within 14 (fourteen) days from the knowledge of the decision. The refund to the customer will be paid after validation of compliance with the conditions described in points 5.5 to 5.8 regarding the exchange and return of these conditions and will not pay any fee arising from said refund.

5.4 The customer's rights related to compensation or reimbursement of expenses, as well as any contractual or extra-contractual liability for direct or indirect damages, to persons or property, caused by the non-acceptance of an order, in whole or in part, are expressly excluded and will not be assumed
